“Having good evidence isn’t always enough. You need to stand out in your entire field—not just at your job,” explained Henry Lindpere, Senior Immigration Counsel at Manifest Law.
In this interactive webinar, Henry walked through real, anonymous visa and green card submissions—including EB-1A, O-1, and EB-2 NIW cases—to reveal how immigration officers assess evidence, interpret standards, and ultimately make decisions.
The result? A candid, practical guide to self-assessing your petition and strategically strengthening it before you file.

What Makes a Petition “Strong” (and What Doesn’t)
EB-1A: USCIS officers don’t just count criteria—they look for final merits: Are you widely recognized in your field?
Four publications and one award might check some boxes, but if your work hasn’t had a measurable, high-level impact, you could still be denied.
O-1: More forgiving than EB-1A, O-1 visas are great for professionals with a strong but still-growing track record. Perfect for startup founders, researchers, and creators with public-facing work or speaking engagements.
EB-2 NIW: This route favors professionals whose work benefits U.S. national interest—especially in fields like public health, policy, research, and defense. Business founders with purely economic arguments tend to struggle here.
Real Examples of Anonymous Submissions
Two sample profiles included:
A biotech researcher with four papers and a global health award—recommended for NIW now, but not yet ready for EB-1A due to limited recognition and early-career stage.
A gaming industry engineer with 15+ years of experience, multiple articles, and public speaking—close to EB-1A level, but needs to amplify public presence and show industry-wide impact beyond their employer.
Practical Evidence-Building Advice
Henry offered expert recommendations on how to strengthen a case:
🎤 Speak at conferences and get quoted in industry media
🧪 Judging others' work is one of the easiest EB-1A categories to build
🧠 Use critical role and original contributions strategically—but know they’re also the hardest to prove
💼 Founders: Use agent filings and independent board members to avoid self-petitioning rejections
