A Notice of Intent to Deny (“NOID”), is a request from USCIS for more information and documentation to make a decision on your application, without which your application will likely be denied.

This varies with each NOID type and case. The maximum response time is 30 days from the date the NOID was issued, but you must always confirm the specific deadline stated in the NOID letter.

Should I get a lawyer for NOID?

While it’s not required, an NOID lawyer can help with an NOID response by carefully analyzing the request and making sure you provide everything you need to get your case approved. This is especially important for complex NOIDs, where working with an NOID attorney can help you understand exactly what to provide.

What is your NOID attorney fee?

NOID attorneys charge different fees based on the complexity of your request for additional evidence. NOID lawyer fees for a response can range from a few hundred dollars for more simple NOIDs to $5,000+ for complex NOID response

What are the chances of approval after NOID?

This depends on how well you are able to respond to your request for additional evidence. If it’s something simple like a translation, and that's the only thing requested, it’s likely they will approve your case when they get the documents. However, the outcome after a more complex NOID that challenges basic qualifications for the visa can be harder to predict. Working with an NOID lawyer can be helpful to maximize your chances of success.

Do lawyers charge extra for NOID?

Most NOID lawyers will charge extra for responding to an NOID, especially if it is a complex response that requires a lot of work. NOID attorneys will look at your request to evaluate what will be needed. The NOID attorney fee may then be determined by the what is needed for the response

What percentage of NOID is approved?

In order to avoid an NOID, it is important to to carefully read the instructions and guidance to make sure you have included everything you need for your filing. This includes properly completed forms, all of the required supporting evidence, and anything else to add such as translations or expert evaluations. You should also make sure you clearly qualify for the visa you are applying for. Weaker cases with less documentation are more likely to get an NOID. You can also speak with a qualified NOID attorney experienced with Requests for Evidence to reduce your chances of an NOID after filing.
